Investment Advisor Nikulski Financial Inc. and Investment Advisor Representative Mr. Brian J. Nikulski were engaged to manage a portfolio for a single person who had some savings and funds which were inherited. Mr. Nikulski recommended five (5) venture capital investments:
- Protégé Sports Inc. /Championship Volleyball Inc.
- OurStage Inc. Series B Preferred
- OurStage Inc. Series D Preferred
- VIRxSYS Corp. Convertible Notes
- EPIC Research and Diagnostics Inc. Series C Preferred
Mr. Nikulski had a conflict of interest in each of them and ultimately each of the five (5) failed with a complete loss of invested funds.
Nikulski’s plan for the investor offered a “Dynamic Allocation Strategy” which he could not explain in asset allocation terms typically referred to by the industry regulator, FINRA. See FINRA’s (Financial Industry Regulatory Authority) website at www.finra.org for an example of building a proper portfolio using asset allocation and diversification.
In October 2020, the case against Nikulski was decided by a retired Federal Court Judge acting as the sole arbitrator and found Nikulski and his firm liable to the investor for $526,596.
